Terms &Conditions.

The rules and responsibilities that govern your use of this website and our coaching services, set out in plain English.

These Terms and Conditions set out the basis on which Magna Heath LTD, trading as Pharm Fitness ("we", "us", "our") provides personal training and nutrition coaching services. By using our website, submitting an application, or engaging us as a client, you ("you", "the client") agree to be bound by these terms.

Section 02

The services we provide

We provide remote personal training and nutrition coaching to private individuals, delivered through:

  • Tailored nutrition plans built around your goals, preferences and lifestyle
  • Personalised training programmes
  • Weekly one-to-one virtual check-in calls
  • Daily WhatsApp support during the agreed coaching period

The specific package, duration and inclusions for your engagement are confirmed in writing before payment.

Eligibility

To engage Pharm Fitness as a client you must:

  • Be 18 years of age or older
  • Be medically fit to undertake exercise and dietary changes
  • Provide accurate information about your health, training history and goals during onboarding
  • Inform us of any pre-existing medical conditions, injuries, or medications that may be relevant to your plan

Health disclaimer

Pharm Fitness does not provide medical advice. Our services are educational and motivational in nature. You should consult a qualified medical professional before beginning any new exercise programme or making significant changes to your diet, particularly if you have any pre-existing medical condition, are pregnant, or are taking prescription medication.

You undertake all training and dietary changes at your own risk. If at any point during your engagement you experience pain, dizziness, or other symptoms, you agree to stop immediately and seek medical advice.

Section 05

Applications and acceptance

Submitting an application form on this website is not a binding contract. We review every application personally and reserve the right to decline any application that is not a good fit for our coaching model. A contract is formed only once we confirm acceptance in writing and you complete payment for an agreed package.

Section 06

Pricing and payment

Our coaching packages are priced on application. The current fee for your chosen package will be confirmed in writing before any payment is requested. Unless otherwise agreed in writing:

  • Full payment is due before coaching commences
  • Payment is made by bank transfer or other method we specify
  • All prices are quoted in pounds sterling (GBP) and are inclusive of VAT where applicable
  • Invoices and receipts are provided on request
Section 07

Cancellation and refunds

Under the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have a 14-day cooling-off period from the date your coaching contract is confirmed, during which you may cancel for any reason.

  • If you cancel within the cooling-off period and coaching has not yet started, you will receive a full refund
  • If you cancel within the cooling-off period after coaching has started at your request, we may deduct a reasonable amount in respect of services already supplied
  • After the 14-day cooling-off period, fees are non-refundable except at our discretion

If we need to cancel or pause your coaching due to circumstances on our side, we will agree a fair pro-rata refund or rescheduling with you.

Section 08

Your responsibilities as a client

  • Provide honest, accurate information about your health, training and goals
  • Follow the agreed plan to the best of your ability, or tell us when something isn't working
  • Attend scheduled check-in calls or give reasonable notice if you need to reschedule
  • Respond to communications within a reasonable time so we can adjust your plan
  • Treat the coach and any team members with respect
Section 09

Communication and response times

Coaching includes daily WhatsApp support during normal working hours, Monday to Friday. We aim to respond to messages within 24 hours on working days. Weekly check-in calls are scheduled in advance and last approximately 30 to 45 minutes.

WhatsApp support is intended for plan-related questions, accountability and adjustments. Urgent medical concerns must be directed to a qualified medical professional.

Section 10

Intellectual property

All nutrition plans, training programmes, written guidance, videos and other materials provided to you remain the intellectual property of Magna Heath LTD. They are licensed to you for personal use only.

You may not share, resell, publish or redistribute any plan, document or programme provided as part of your coaching without our prior written consent.

Section 11

Confidentiality

We treat your personal information, health information, photos and progress data as confidential and use them only as needed to deliver your coaching. We will not share testimonials, before-and-after photos or identifying details publicly without your explicit consent.

Section 12

Results and expectations

Results from coaching depend on a wide range of factors including consistency, effort, biology, sleep, stress and life circumstances. While we work hard to deliver outcomes for every client, we cannot and do not guarantee specific physical, body composition or performance results.

Any testimonials or client outcomes shown on this website reflect those individuals' experiences and are not a promise of identical results.

Section 13

Limitation of liability

Nothing in these terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under UK law.

Subject to the above, our total liability to you in respect of any claim arising from your coaching engagement is limited to the total fees paid by you under that engagement.

We are not liable for indirect or consequential losses, or for any injury, illness or loss arising from your failure to follow medical advice, your dishonest disclosure of relevant health information, or activity undertaken outside the scope of the agreed plan.

Section 14

Termination

We may terminate or pause your coaching with immediate effect if you breach a material term of this agreement, behave abusively toward us, or make our continued involvement unsafe or impracticable. In such cases, fees already paid are not refundable.

You may terminate your coaching by giving us notice in writing. Refunds after the cooling-off period are at our discretion as set out in Section 07.

Third-party links

Our website may link to third-party websites or services. We are not responsible for the content, accuracy or practices of those third parties.

Section 16

Changes to these terms

We may update these Terms and Conditions from time to time. The latest version will always be published on this page with the effective date shown at the top. Material changes affecting existing clients will be communicated directly.

Section 17

Governing law and jurisdiction

These Terms and Conditions are governed by the laws of England and Wales. Any dispute arising under or in connection with them is subject to the exclusive jurisdiction of the courts of England and Wales.
